Section 01
Agreement to these Terms
These Terms of Service (“Terms”) form a binding agreement between you and DLM(“Spinn Radio”, “we”, “our” or “us”) governing your access to and use of the Spinn Radio website, Progressive Web App, Android app and iOS app (the “Service”).
By creating an account, installing the app or using any part of the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please discontinue use of the Service.
Section 02
Eligibility
You must be at least 13 years old (or 16 in the EEA / UK) to use the Service. By using Spinn Radio you represent that you meet the age requirement and that you have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Section 03
What the Service does
Spinn Radio is a free internet radio app that includes:
- An interactive 3D globe of 50,000+ radio stations from 200+ countries.
- Audio-reactive visualizations and a unified Now Playing experience.
- Curated playlists, podcast discovery, music videos and live IPTV music channels.
- A movies & trailers section powered by TMDB and YouTube.
- A sports directory with leagues, teams, athletes, talk shows and highlights.
- An optional social layer (favorites, posts, comments, messages, schedules).
- Optional Spinn Radio Pro subscription with premium features.
We may add, modify or discontinue features at any time. We will give reasonable notice for changes that materially reduce paid functionality.
Section 04
Accounts
You may use most of the Service without an account. Creating an account (via Google or Sign in with Apple) lets you save favorites, sync history, and enable Pro. You are responsible for the activity that happens under your account and for keeping your credentials secure. Notify us immediately at security@dlmradio.com if you suspect unauthorized access.
Section 05
Subscriptions, billing & refunds
Pro is optional. Free users keep all the radio listening, just with fewer extras.
How billing works
- Web & Android (web checkout): handled by Stripe. Payment is collected by Stripe as our payment processor.
- iOS: handled by Apple In-App Purchase. Apple is the merchant of record; entitlements are verified server-side via Apple's App Store Server API.
- Android (Play Store): handled by Google Play Billing. Google is the merchant of record.
Recurring billing
Pro subscriptions auto-renew at the end of each billing period at the then-current price. You can cancel at any time and your access continues through the end of the paid period. Cancel via the in-app billing screen, the Stripe portal, or the subscription settings of your App Store / Play Store account.
Refunds
Refunds for web purchases are issued at our discretion within 14 days of the initial charge. Refunds for App Store and Play Store purchases follow Apple's and Google's respective refund policies — please request them directly through your store account.
Promotional codes & trials
Promotional offers may be limited, non-transferable, and subject to additional terms. Trials convert to paid subscriptions when they end unless you cancel beforehand.
Section 06
Acceptable use
A few things to keep the Service safe and lawful for everyone.
You agree not to:
- Use the Service in violation of any law, regulation or third-party right.
- Reverse engineer, decompile, or attempt to extract source code outside what is permitted by law.
- Scrape, mass-download, mirror, or programmatically harvest data without our written consent.
- Re-broadcast, re-stream, re-encode, or otherwise redistribute audio, video or other copyrighted content accessed via the Service.
- Interfere with or disrupt the Service, our infrastructure, or other users — including by overloading the system, attempting to bypass rate limits, or probing for vulnerabilities.
- Upload abusive, infringing, harassing, hateful, sexually explicit, or otherwise unlawful content via the social or messaging features.
- Impersonate another person, misrepresent your affiliation, or use the Service to defraud anyone.

Third-party content & playback
Spinn Radio is a discovery layer over content owned by third parties. Here's how that works.
The radio stations, podcasts, music videos, movies, sports highlights and athlete / artist information you encounter in the Service are owned, produced and operated by third parties — broadcasters, record labels, film studios, podcast publishers, sports leagues, encyclopedias and individual creators. We do not host, transcode or rebroadcast their long-form content.
Audio and video play directly from the rights-holder's own infrastructure or embedded player (e.g. an HLS endpoint operated by the broadcaster, the YouTube IFrame Player). Their separate terms, privacy policies and any advertising controls apply once playback begins.
We make no representations about the accuracy, quality, lawfulness, or availability of third-party content. We may remove or restrict access to content that is unavailable, infringing, or violates these Terms.

Content licensing & commercial-use rights
The legal basis on which Spinn Radio can commercially display the metadata, artwork and embeds you see in the app.
Spinn Radio operates as an authorized commercial consumer of every third-party API listed below. Each API's published Terms of Service expressly grant us — and other commercial developers — a worldwide, non-exclusive, royalty-free right to fetch, cache and display the data within our Service, including in paid (Pro) tiers. Where a provider requires attribution, we display it on the relevant surface.
For long-form copyrighted media (full songs, full films, full episodes), we never self-host or rebroadcast — instead, we surface the rights-holder's own embed, HLS endpoint or RSS-linked file, leaving licensing, monetization and ads under their control.

Radio Browser
Policy ↗Live radio station directory, stream URLs, country / tag / language metadata that powers the globe and search.
License: Public-domain community dataset (CC0-style). Free for commercial display and redistribution; we cite the source on relevant surfaces.
TheSportsDB
Policy ↗Sports leagues, teams, athletes, badges, biographies and event metadata.
License: Free + paid commercial tiers; the API Terms expressly authorize commercial display in our app with attribution.
The Movie Database (TMDB)
Policy ↗Movies, TV shows, posters, cast, crew, trailers and ratings used across /movies and actor pages.
License: Used under the TMDB API Terms of Use, which grant a worldwide, royalty-free right to commercially display TMDB data with attribution. This product uses the TMDB API but is not endorsed or certified by TMDB.
Last.fm (Audioscrobbler)
Policy ↗Artist biographies, tags, similar artists, top tracks, listener counts.
License: Used under the Last.fm API Terms of Service, which permit commercial display of metadata and artwork with attribution.
Deezer Public API
Policy ↗Artist images, album artwork, 30-second previews, track metadata.
License: Used under the Deezer API Permissions, which permit commercial display of artwork and previews with attribution.
iTunes Search & Apple Podcasts
Policy ↗Podcast discovery, episode listings, RSS feed resolution, high-resolution podcast artwork.
License: iTunes Search API is granted by Apple for commercial use to drive engagement with Apple platforms; episode RSS feeds are public publisher feeds.
Wikipedia REST API
Policy ↗Fallback bios, summaries, and portrait images for artists, athletes, actors and more.
License: Wikipedia text and images are licensed under Creative Commons BY-SA 4.0 — free for commercial reuse with attribution and share-alike (where applicable).
YouTube IFrame Player API
Policy ↗Embedded music videos, movie trailers, sports highlights, choir performances, free public-domain films.
License: Used under the YouTube API Services Terms of Service. We do not download, modify or rebroadcast videos — playback occurs in YouTube's own player so the rights-holder retains full control of monetization, ads and licensing.
Public radio & HLS streams
Internet radio and IPTV music-video channels (Stingray, Vevo, XITE, Trace, Deluxe, public broadcasters, etc.) accessed via the broadcaster's own publicly published HLS / Icecast endpoint.
License: Pull-only references to publicly broadcast streams. We do not re-host, re-encode or strip ads. The original broadcaster controls availability and licensing.

Section 09
Our intellectual property
The Spinn Radio name, the Spinn logo, the Spinn red color system, the 3D globe experience, the application source code, the visual designs, the curated catalog arrangements, and all other proprietary materials (excluding third-party content) are owned by DLM and protected by copyright, trademark, trade-dress and other intellectual-property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. No other rights are granted by implication or estoppel.
Section 10
Your content
What you post stays yours — but we need a license to display it.
You retain all rights to the content you post, upload or share through the Service (favorites, playlists, posts, comments, messages, profile artwork). By submitting content, you grant Spinn Radio a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (e.g. resize images), display and distribute that content solely for the purpose of operating, providing and improving the Service.
You represent that you have all necessary rights to the content you submit and that it does not infringe any third party's rights or violate any law.
Section 11
DMCA & copyright complaints
We respect intellectual property rights. If you believe content available through the Service infringes your copyright, send a notice to legal@dlmradio.com including:
- A description of the copyrighted work claimed to be infringed.
- The URL or identifier of the allegedly infringing material in the Service.
- Your contact information (name, address, phone, email).
- A statement of good-faith belief that the use is unauthorized.
- A statement, under penalty of perjury, that the information is accurate and you are the rights-holder or authorized to act on their behalf.
- Your physical or electronic signature.
We will respond to valid notices in a manner consistent with the DMCA and similar laws, including by removing or disabling access to the material and notifying the provider where appropriate.
Section 12
Disclaimers
The Service is provided “as is” and “as available” without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement and any warranty arising from course of dealing or usage of trade. We do not guarantee that the Service will be uninterrupted, secure, error-free, or that any defects will be corrected. We do not warrant the availability, accuracy or completeness of third-party content.
Section 13
Limitation of liability
To the fullest extent permitted by law, in no event shall DLM, Spinn Radio, our affiliates, officers, employees, agents or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data, goodwill or other intangible losses, arising from or related to your use of (or inability to use) the Service — even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.
Section 14
Indemnification
You agree to indemnify, defend and hold harmless DLM and its affiliates from and against any claims, damages, liabilities, losses, costs and expenses (including reasonable attorneys' fees) arising from (i) your use of the Service, (ii) your violation of these Terms, (iii) your violation of any third-party right, including intellectual-property or privacy rights, or (iv) any content you submit to the Service.
Section 15
Suspension & termination
You may stop using the Service at any time. You can permanently delete your account and data through the in-app settings or our Delete Account & Data page.
We may suspend or terminate your access — in whole or in part, with or without notice — if we reasonably believe you have violated these Terms, if required by law, or if continued operation poses a security or legal risk. Sections that by their nature should survive termination (intellectual property, disclaimers, liability caps, indemnification, governing law) will survive.
Section 16
Governing law & dispute resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.
Where local consumer-protection laws give you stronger rights than these Terms (for example, in the EU), those local rights are not diminished.
Section 17
Changes to these Terms
We may update these Terms as the Service evolves, when laws change, or to reflect new third-party integrations. Material changes will be flagged in-app and the updated date at the top of this page will reflect the revision. Continued use of the Service after a change constitutes acceptance of the updated Terms. If you do not agree, you may stop using the Service and delete your account.
